1. Agreement to Terms
By accessing or using the FosterTRAIN platform and services ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, then you may not access the Service. These Terms apply to all visitors, users, and others who access or use the Service, including but not limited to Foster Care Agencies, Trainers, and Attendees ("Users").
2. Use of the Service
FosterTRAIN provides a comprehensive training management platform for the foster care community. You agree to use the Service only for its intended purposes and in compliance with all applicable local, state, national, and international laws and regulations.
3. User Accounts
When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service. You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party.
4. Fees, Payment, and Refunds
a. Fees and Billing:
Access to certain features, including those for Agencies, External Trainers, and Administrators, is conditioned upon timely payment of the applicable subscription fees outlined on our Pricing Page.
b. Payment Terms:
You agree to pay all fees in advance for the applicable billing cycle (e.g., monthly, annually). You authorize FosterTRAIN to charge your designated payment method on the first day of each billing cycle. Unpaid amounts are subject to termination of service.
c. Automatic Renewal:
All paid subscriptions automatically renew for subsequent terms of the same duration unless you cancel your subscription prior to the renewal date.
d. Cancellations and Refunds:
All fees are non-refundable once paid. FosterTRAIN does not provide refunds or credits for any partial months or years of service or for non-use during the subscription period.
e. Changes to Fees:
FosterTRAIN reserves the right to change its fees at any time. We will provide Users with adequate notice (e.g., 30 days) of any price change before it takes effect.
5. Content
Our Service allows you to post, link, store, share and otherwise make available certain information, text, graphics, videos, or other material ("Content"). You are responsible for the Content that you post to the Service, including its legality, reliability, and appropriateness. By posting Content to the Service, you grant us the right and license to use, modify, publicly perform, publicly display, reproduce, and distribute such Content on and through the Service. FosterTRAIN does not claim ownership of your Content, but you grant us a license to use it in connection with operating the Service.
6. Intellectual Property
The Service and its original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of FosterTRAIN and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.
7. Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.
8. Disclaimer and Limitation of Liability
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. FosterTRAIN makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties. In no event shall FosterTRAIN, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service, including without limitation any loss, damages, or interruption of service caused by the failure or unavailability of third-party infrastructure or service providers (e.g., cloud platforms, data centers).
9. Third-Party Services
The FosterTRAIN platform utilizes third-party infrastructure and services (including, but not limited to, Base44) to operate. FosterTRAIN disclaims any liability or responsibility for the operation, functionality, security, or availability of these third-party services. You acknowledge and agree that your use of the Service is subject to the terms and conditions of these third-party service providers. Failures, outages, or security breaches of any third-party service provider are considered events outside of FosterTRAIN's reasonable control.
10. Governing Law
These Terms shall be governed and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
11. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any changes by posting the new Terms on this page. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
