1.Summary
FosterTRAIN Does Not Guarantee Reimbursement, Licensing Approval, or Compliance Certification
This disclaimer applies to every part of the Service, including attendance tracking, certificate generation, funding-related reporting, billing summaries, and any export described as supporting Title IV-E documentation.
2.Administrative Software, Not a Government Program
FosterTRAIN is a private software company. It is not a government agency, a state department of social services, a county child welfare agency, a community college district, or an agent of any of them. Nothing in the Service is an official statement, determination, or approval by a government body.
References in the Service to Title IV-E, federal or state funding, county partnerships, or reimbursement describe recordkeeping fields and reports that Customers may choose to use. They are not a representation that any particular training, participant, or expense is reimbursable.
3.Eligibility Determinations Are Made by Government Authorities
Whether a training, participant, hour, or cost qualifies for Title IV-E or other public funding is determined solely by the applicable federal and state statutes, regulations, and the reviewing government authority. We do not make eligibility determinations, do not pre-approve claims, and cannot guarantee that a claim built from our reports will be accepted, paid, or defended on audit.
4.No Guarantee of Funding, Licensing, or Certification Outcomes
Specifically, FosterTRAIN does not guarantee:
- that any training or participant will be deemed eligible for state or federal reimbursement;
- that a claim, invoice, cost report, or reconciliation assembled from our data will be accepted or paid;
- that a generated certificate, transcript, or attendance record will satisfy a licensing board, court, county, or accreditation standard;
- that use of the Service constitutes or evidences compliance with any statute, regulation, contract, or corrective action plan;
- that records retained in the Service will be sufficient for an audit, investigation, or public records request.
Any statement in marketing materials, documentation, in-app guidance, or conversation that describes how Customers typically use the Service is descriptive only and is not a guarantee of an outcome in your circumstances.
5.Record Accuracy and Audit Readiness Are the Customer's Responsibility
Reports, invoices, and certificates are generated from data entered by the Customer and its authorized users. We do not verify attendance, hours, credentials, trainer qualifications, signatures, or the identity of participants.
The Customer is responsible for:
- Validating every record it submits to a funding authority.
- Retaining supporting documentation for the period the authority requires.
- Responding to audits.
- Confirming that electronic signatures and self-reported attendance methods satisfy applicable legal and contractual requirements.
6.Rates, Funding Levels, and Program Rules May Change
Reimbursement rates, allowable costs, eligible training categories, and reporting rules are set and revised by government authorities and funding partners. The Service may allow a Customer to configure rates or expectations; those configurations are the Customer's assumptions, not approved rates. We are not responsible for losses caused by a change in law, funding availability, or an authority's interpretation of its rules.
7.No Legal, Financial, or Compliance Advice
Content in the Service, including templates, checklists, guidance text, and AI-assisted responses, is provided for general administrative convenience and does not constitute legal, tax, accounting, financial, or compliance advice. Consult qualified counsel or your funding authority before relying on any interpretation of a reimbursement or licensing rule.
8.Limitation of Liability for Funding and Compliance Outcomes
To the maximum extent permitted by law, FosterTRAIN is not liable for any denied, reduced, recouped, or delayed reimbursement; for any licensing, accreditation, or certification decision; for any penalty, corrective action, or finding issued by a government authority; or for any related lost revenue, lost funding, or reputational harm, whether the claim is in contract, tort, or otherwise. The limitations of liability in our Terms of Service apply in full to this disclaimer, including the exclusion of consequential damages and the aggregate liability cap.
